In sintesi si è proposta una interrogazione sostanzialmente articolata sui seguenti punti:

1) non si comprendono le motivazioni per cui l'Amministrazione ha evitato il ricorso ad una gara di evidenza pubblica per l'assegnazione del servizio in parola, come non è chiara la ragione per cui, la medesima, non ha inteso valutare e comparare le offerte di altre imprese in possesso dei requisiti per l'assegnazione del servizio secondo il modello dell' in house providing ;

2) a seguito del controverso e doloroso accordo transattivo con il Consorzio GAIA SpA e l'esperienza del Comune di Rocca Priora nell'affidamento diretto del servizio di gestione dei RSU, nei confronti del quale, nell'ottobre del 2007, la Commissione Europea ha aperto un procedimento di infrazione contro lo stato italiano, si riteneva auspicabile oltre che opportuno, attendersi uno studio ben più attento e approfondito rispetto alle scarne motivazioni portate in Consiglio dall'Amministrazione a sostegno del modello organizzativo adottato e della società affidataria prescelta. Si ritiene intollerabile che il Consiglio Comunale, espressione dell'intera popolazione, debba esprimersi su questioni estremamente delicate e di vitale importanza, senza poter analizzare, studiare ed approfondire con la dovuta calma tutti i cambiamenti statuari apportati dalla società affidataria e le condizioni offerte dalla medesima. E' evidente come tale modo di procedere svilisca il ruolo istituzionale e la dignità del Consiglio Comunale, riducendolo ad un mero passaggio burocratico per ottenere una formale, ma non sostanziale approvazione, in ordine a decisioni evidentemente già concordate su altri tavoli;

3) si è osservata una dubbia intromissione da parte dell'Amministrazione, ed in particolare del Sindaco, in questioni squisitamente tecniche che esulano dalle competenze in capo all'organo politico. In altri termini, ci è sembrato che il principio di separazione tra sfera politica e sfera gestionale e, in special modo, tra attività di indirizzo e controllo e quella di gestione, non sia stato rispettato nella questione di che trattasi, con la conseguenza che è venuto a meno il presupposto secondo il quale le decisioni sui casi concreti debbano essere adottate in piena autonomia dagli organi tecnici.
